PushButtonResponse Anti-Spam Policy
By subscribing to the PushButtonResponse Service, the Customer agrees to use it in compliance with the Terms of Service and the PushButtonResponse Anti-Spam Policy stated below.
We, at PushButtonResponse, love Internet commerce and we hope our Service will make it easier for everyone, yet we will absolutely, positively not tolerate spam while using our services.
You may never use the Service to send unsolicited and unwanted correspondence to anyone.
You may not use the Service to send messages, unless you obtain prior consent from the particular addressee, as defined by the CAN SPAM Act of 2003, as well as the Directive 2000/31/EC of the European Parliament and Council of 8 June 2000, on legal aspects of information society services, in particular, electronic commerce in the Internal Market ('Directive on Electronic Commerce'), along with the Directive 2002/58/EC of the European Parliament and Council of 12 July 2002, concerning the processing of personal data and the protection of privacy in the electronic communications sector (‘Directive on Privacy and Electronic Communications).
Each email message that is sent through the Service includes an unsubscribe link that enables the recipient to unsubscribe from receiving electronic messages from you in the future, upon clicking on the unsubscribe link.
1. Building Your List
You are not allowed to send email messages to persons who did not express their consent to receive such information from you.
You are expressly prohibited from gathering email addresses to your mailing list through surreptitious methods (e.g. scraping or harvesting).
The recipients may request to be added to your mailing list by sending an email to your account or filling out a form on your website. You can also import a list of email addresses of your recipients if they previously agreed to be a part of your list.
An email address will be automatically added to your account as soon as it is submitted, unless you require a confirmed opt-in option. With the 'confirmed opt-in', upon each request, a confirmation message is first sent to the email address with a request of the confirmation that this address should indeed be added to the list. We advise you to inform your recipients in the very first message that their email address was added to your mailing list and you will send out further messages regarding particular issues to this address.
In order to add the individual recipient to your mailing list by yourself, you need to enable the 'confirmed opt-in' feature. You must have your recipients' express permission to process their data, and advise them that they will receive a Service provider's request to confirm their intention to subscribe to your list.
2. Contents of Your Messages
You need to provide true and accurate information to be used in the email message headers, i.e. "From address" and "Reply to" fields. The email message headers and the subject may not be misleading, false or deceptive to its recipients, as regards the character of the content and the purpose of the message.
3. Postal Address
You must provide the Service with your accurate physical postal address. We will include the postal address within the content of each email message in your campaigns, pursuant to the CAN-SPAM requirements. The postal address will appear in the footer of all your emails.
You are required to keep the afore-stated information up to date and, therefore, you may change it from campaign to campaign, in the event of data change.
PushButtonResponse will be monitoring all outgoing email messages to ensure that a valid postal address is displayed. If we find a problem with an address that has been entered in the particular campaign, we will contact you immediately to clarify the inconsistency.
4. Removals
You are not allowed to send messages to any individual who had been added to your mailing list in the past, but later unsubscribed from it. PushButtonResponse automatically handles on your behalf unsubscribe requests and provides you with a list of individuals who unsubscribed from the mailing lists in your account.
You may never spam via our Service or send spam that in any way implicates our services. This relates to displaying a pushbuttonresponse email address or the URL in a bulk message, or including such addresses in a bulk-advertised web page. You may not hide behind throwaway web pages or fax-response front ends.
Furthermore, you may not use email lists that have been rented, leased or purchased.
If you spam, even if pushbuttonresponse services are not directly involved in it, yet the spam leads the person to pushbuttonresponse services, you will:
- have your account terminated immediately without notice and refund, and you will be charged a $500 cleanup fee
- be reported by us to your ISP as a spammer, which will most presumably lead to terminating your account as well
- be reported to the appropriate authorities
